1. Terms and Conditions
These Terms and Conditions constitute a legally binding agreement between you (the “Client”) and PxlPerfect Designs (“we,” “our,” or “us”). By hiring us for any project, purchasing services, or interacting with our website, you acknowledge that you have read, understood, and agreed to these terms. If you do not agree, you should refrain from using our services.
2. Fees and Costs
All service fees are clearly outlined in our proposals, quotes, or project agreements. Additional charges may apply for extra features, revisions beyond the included rounds, rush deadlines, or scope changes after the initial agreement. We reserve the right to adjust our pricing at any time, though existing projects will maintain their agreed rates unless scope changes.
3. Payment
All payments are due according to the terms outlined in the project agreement. A deposit is typically required to begin work, with the balance due upon project milestones or final delivery. We accept secure payments via PayPal or other approved methods. Late payments may incur interest charges or suspension of services until balances are cleared.
4. Timing
​We strive to meet all project timelines and deadlines as discussed. However, timelines depend on client responsiveness, content delivery, and approvals. Delays in providing feedback or required materials may result in rescheduling or extended delivery times. While we aim to deliver on time, we are not liable for delays caused by external factors or third-party services.
5. Intellectual Property Rights
Upon full payment, the final approved design, website, or deliverable will be owned by the client, excluding any third-party tools, plugins, or software used under license. PxlPerfect Designs retains the right to showcase completed work in our portfolio or marketing materials. Drafts, concepts, and unused designs remain the intellectual property of PxlPerfect Designs.
6. Warranties and Liability
We provide services with reasonable care and skill, but we do not guarantee that our work will be error-free or meet all unforeseen requirements. PxlPerfect Designs shall not be held liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services, including loss of data or business interruption.
7. Confidentiality
We value your privacy and confidentiality. Any sensitive information shared with us will be kept strictly confidential and used only for the purpose of completing your project. We will not share, distribute, or disclose client information to third parties unless required by law or with your express written consent.
8. Termination
Either party may terminate a project agreement with written notice. In the event of termination, the client will be invoiced for all work completed up to that point. If a deposit was paid, it is non-refundable unless otherwise agreed upon in writing. PxlPerfect Designs reserves the right to suspend or terminate services due to non-payment, breach of terms, or misconduct.
9. Non-Solicitation
Clients agree not to solicit or hire PxlPerfect Designs’ employees, contractors, or collaborators for independent work or employment outside of this agreement for a period of 12 months following the end of the client relationship. This clause helps protect the continuity and integrity of our team and service delivery.
10. General
These terms are governed by the laws of the State of Texas, USA. Any disputes arising out of or relating to these terms shall be resolved in the courts of applicable jurisdiction. These Terms and Conditions supersede all prior agreements, oral or written, between the parties. If any part of these terms is found unenforceable, the remainder will remain in effect.
11. Definitions
Client: The individual or entity hiring PxlPerfect Designs for services.
Services: Web design, development, SEO, or other digital services provided by PxlPerfect Designs.
Deliverables: The final product(s) provided upon project completion.
Agreement: The written or verbal understanding of project scope, timelines, and pricing.
